Question: I put up a vinyl fence per the building code of the park, and then my neighbor added a wood gate to his property against the building code and the manager approved this. Is this discrimination? What can I do about this?

Answer: Under the Arizona Mobile Home Parks Residential Landlord and Tenant Act (A.R.S. Title 33 Chapter 11), rules or regulations adopted by the landlord concerning tenants’ use and occupancy of the premises must “apply to all tenants on the premises in a fair manner” (A.R.S. 33-1452). If you feel strongly about learning what, if anything, you may do in response to your landlord’s apparent failure to apply the rule or regulation related to fences and gates in your park “fairly,” you can always speak with an attorney.
