Landlord and Tenant - Mobile Home Parks
questions & answers
Question: There is a trailer for sleep in a 55+ community. Am i able to purchase the home as remove it from the community to a me plot of land i recently purchased?
Answer: So long as whomever is selling the home is legally permitted to do so (the seller owns it; it is not being leased or subleased to someone else through a rental agreement; etc.), then anyone may purchase it and move it elsewhere. Under the Arizona Mobile Home Parks Residential Landlord and Tenant Act (A.R.S. Title 33, Chapter 11), a landlord “may not deny any resident of a mobile home park the right to sell the resident’s mobile home at a price of the resident’s own choosing during the term of the tenant’s rental agreement, but the landlord may reserve the right to approve the purchaser of such mobile home as a tenant” (A.R.S. 33-1452(F)(3)).
