Landlord and Tenant - Mobile Home Parks

questions & answers

Question: We are in a 55 + park are they allowed to have children in the park and if so for how long. I paid to be in a 55+ park for a reason. And now I am upset these kids are here till after Christmas and they are right next door. What are my rights

Answer: There are no general rules in Arizona regarding the length of time that a guest (of any age) may stay with a resident of an age-restricted mobile home park. The individual statements of policy of each mobile home park and the specific terms of the rental agreement between the mobile home park landlord and the mobile home park tenant are what govern such things. If you believe that the children are violating a statement of policy and/or your rental agreement – not simply by being there (which is undoubtedly permitted) but instead by making noise (etc.) – you may wish to contact your landlord in writing to explain the situation and request that they remind the children’s hosts of their obligations to the rest of the community.
