The only way to break one’s lease without penalty is if the rented property is uninhabitable. There are other ways to break the lease but penalties will be involved. Find the section in your leasing agreement that details penalties or fees for breaking the agreement as well as the conditions in which the property should be left. You can pay these fees and vacate the property but could be held liable for the rental payments until a new tenant is found. Review Arizona’s Residential Landlord and Tenant Act for specific language regarding your issue.
