Question: Tenant has been on property for four months on a month-to-month lease. I wish to terminate his lease by giving him a 30-day letter at the first of the month stating ....In accordance with your lease and applicable sections of Arizona Rental Law, this is your notification that your lease will terminate on 1 ___, 2015....." Must I give a reason other than month to month lease? Must tenant reside on property for more than a year before this termination is possible?? Thank you for your assistance

Answer: You may terminate the lease pursuant to A.R.S. 33-1375(B), which provides: B. The landlord or the tenant may terminate a month-to-month tenancy by a written notice given to the other at least thirty days prior to the periodic rental date specified in the notice. There is no requirement that the tenant have been for any length of time prior to such termination. You need not give any reason. You only need cite the statute. You only have the right to terminate 30+ days from the next rent due date. So if it's the 1st of the month, you can terminate effective June 30, 2015 by giving effective written notice prior to June 1, 2015.
