Question: I have a prescription from a doctor stating I can have a companion dog for my depression and anxiety, can the landlord evict me?
Answer: According to 28 C.F.R and 36.104, a service animal is a dog which has been trained to perform tasks for an individual with physical, psychiatric, intellectual, or other mental disabilities. According to the ADA, a landlord must make reasonable accommodations for tenants with disabilities. Thus, a landlord cannot evict a tenant because of a service dog.
