Landlord and Tenant - Mobile Home Parks

questions & answers

Question: What are the Arizona laws regarding tenants rights, while residing in a private RV park, concerning eviction?

Answer: This answer is for general information only. To see how the law applies to your specific case, please consult a lawyer. Chapter 11 of Title 33 of the Arizona Revised Statutes, the Arizona Mobile Home Parks Residential Landlord and Tenant Act, sets out the laws regarding landlord/tenant issues in mobile home park. ARS 33-1475 discusses recourses for tenants who have been unlawfully removed. Some remedies include recovering the rental agreement or recovering a specific amount of money, as outlined in the statues. ARS 33-1476 governs the termination of a rental agreement due to tenant noncompliance. According to the statute, a landlord “may not terminate or refuse to renew a tenancy without good cause.” As stated in section B, "good cause" includes, but is not limited to, noncompliance with the rental agreement and nonpayment of rent. ARS 33-1491 states that “a landlord shall not retaliate by increasing rent or decreasing services or by bringing or threatening to bring an action for eviction” after a tenant files complaints with government agencies, courts, or unions.
