Question: i have rented from a large realtor for 10 yrs same property my rent is due on the 4th of each month everyone elses due on the 1st at times i have aquired late fees im thinking this is office confusion because of the date can i ask for a print out of all payments to them to check legitiment late fees?

Answer: Yes, you can ask the landlord for documentation showing the history of rent payments. Landlord tenant conduct is governed by the Arizona Landlord Tenant Act, but there is no provision that requires that landlord to keep records of rent payment. The prudent landlord maintains files on each of his rental units, documenting the occupants, rent payment records, and everything else which pertains to this unit over its history. If the landlord does not provide record of late payment, the tenant will need to show proof the payment was made on time. As between landlord and tenant, if records are missing, the landlord typically loses.
