Question: I signed a lease that was marked that we would be provided with a washer and dryer. We move in and there is no washer and dryer available. Landlords said washer and dryer are convenience only. All they are doing is apologizing for it but not providing a washer and dryer. It’s marked on the lease! Can they do that?
Answer: If a rental agreement states that the landlord will provide the tenant with a specific service or appliance, then the landlord must do so. If the landlord does not provide the promised service or appliance, then the landlord is in violation of the rental agreement. A tenant whose landlord is in violation of the rental agreement may wish to send the landlord a signed and dated letter (keeping a copy for the tenant’s own records) reminding the landlord of what the rental agreement states and requesting that the landlord provide the promised service or appliance as soon as reasonably possible.
