Question: I am an independent student at ASU and resident of Tempe, AZ. I have four months left on my residential lease. With the COVID-19 National Emergency announcement and ASU cancelling all on campus sessions, I would like to cancel my lease for the rest of the semester and move in with family. The Arizona Residential Landlord and Tenant Act makes no mention of National Emergencies and rights extended to tenants. My lease agreement also has no provisions, including none for Force Majeure. Any guidance you can provide would be appreciate. Respectfully,

Answer: Unfortunately, there is currently no Arizona law that would permit a residential tenant to terminate a rental agreement early without penalty due to the COVID-19 crisis. Any tenant who wishes to do so may wish to communicate with their landlord and attempt to reach a mutually satisfactory agreement – in writing.
