Question: Landlord falsely advertised well water for property. Saw a water delivery truck come to our yard. Questioned landlord. Said “his mistake” well dried up 2 years ago. Now expects us to pay for water delivery. Is that legal?

Answer: Unless the Landlord promised a certain type or kind of water, it is probably not false advertising to provide water by delivery truck. So long as the Landlord is providing water, then the Landlord is in compliance with the lease. If the Tenant is required to pay for water under the terms of the lease, the Tenant must pay for the water and it does not matter how the water is delivered to the rental, so long as the delivery is legal. There may be local housing codes that regulate the manner and quality of water delivered to residential homes.
