Landlord and Tenant Rights and Responsibilities

questions & answers

Question: I live in a RV park and the landlords have constantly shut off water without notice sometimes for days and have came on to my lot without notice and been rude and complaining that I complain too much and to go buy my own water. I have stage 4 cancer and am being bullied and denied basic water for showering cleaning cooking using my restroom the list keeps going what can I do?

Answer: Under the Recreational Vehicle Long-Term Rental Space Act, RV park landlords are required to “make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition” and “comply with all applicable provisions of city, county and state codes materially affecting health and safety” (A.R.S. 33-2123). RV park landlords are also required to “provide a statement of proposed interruption of utility service to the tenants within a reasonable time, except in the case of an interruption caused by an emergency. An emergency does not include any failure or refusal by the landlord to fulfill the duties and obligations to maintain fit premises. A statement of proposed interruption of utility service may be provided by posting an announcement of the period of the interruption in a conspicuous place on the premises where a recreational vehicle space is located or by individual delivery to each tenant” (A.R.S. 33-2107(E)). If your RV park’s landlord has breached these obligations, and you would like legal advice or assistance, there are links to free and low-cost legal services on this website (at http://www.azlawhelp.org/accessToJustice).
