Question: Does the landlord have the right to assign a renter any apartment without disclosing which one it is when the lease is signed?
Answer: The Arizona Residential Landlord and Tenant Act (ARLTA) defines a rental agreement as an agreement “embodying the terms and conditions concerning the use and occupancy of a dwelling unit and premises” (A.R.S. 33-1314). Because term “dwelling unit” refers to a particular rented space, rather than to an entire housing complex, the rental agreement signed by the tenant and the landlord should identify the specific unit that the tenant will be renting.
