Landlord and Tenant Rights and Responsibilities

questions & answers

Question: I was out starting to prune my Mesquite Tree and noticed a large Bee Hive and Honey Comb. I came inside and called a Bee Removal because I didn't want to get Stung or my dogs. I had my Landscapers coming that afternoon to prune all my trees in preperation for the Moonsoons. My Lease states that I am responsible for yard maintence which I have done for nearly 7years. WHO IS RESPONSIBLE FOR THE REMOVALE AND HONEY COMB

Answer: Unfortunately, the Arizona Residential Landlord and Tenant Act (ARLTA) does not contain definite answers to such detailed questions. All the ARLTA says is that landlords are required to “make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition” (A.R.S. 33-1324). When neither the rental agreement nor the ARLTA addresses a particular issue, it is usually up to the landlord and the tenant to try to negotiate a mutually satisfactory resolution.
