Landlord and Tenant Rights and Responsibilities

questions & answers

Question: I moved into my house last year, and I just renewed my lease. I went to replace the batteries in my fire alarms and it says they needed to be replaced in 2015. I filed a work order with the landlord and they texted me to find out what was wrong bur never came to fix the problem. Is this a requirement for them to fix?

Answer: Under Arizona law, all new and remodeled residential housing units require working smoke detectors. A.R.S. 36-1637(B) says the following: “A smoke detector ... shall be maintained and kept operable by the tenant unless the tenant gives written notification to the landlord of its malfunction. The landlord shall be responsible for the repair of a smoke detector if such notice is given by the tenant.”
