Question: I took a rental on a month-to-month basis didn't realize they were in such Dire Straits financially I gave them two months worth of rent in advance what is it that I do when now I'm being told the home is up for sale in the past month I have given them close to $3,000 what is it do I do

Answer: Under Arizona law, a residential landlord must return a tenant’s refundable deposit within 14 days after the tenant moves out and the landlord has received from the tenant a written demand for the return of the deposit (A.R.S. 33-1321(D)). If a landlord takes a tenant’s money but the tenant does not later obtain the benefit of the agreed-upon bargain (in the landlord/tenant context, the occupation and enjoyment of a rented dwelling), then the tenant may sue the landlord in court for whatever monetary damages the tenant has suffered.
