Question: My boyfriend and I rent a mobile home in Glendale AZ. The mobile home park has the electric in the parks name and we just pay the park for electricity. 3 days ago the main breaker blew and was smoking, this is not the first time the breaker box smoked, srp came out and said it was the parks responsibly to replace the box. An unlicensed electrician that lives in the park has yet to fix the problem. The owner knows of the problem and has done nothing. I just recently had a stroke and my boyfriend is a diabetic. His insulin needs refrigerated and has not so $3200 worth of insulin went bad.
Answer: Under the Arizona Mobile Homes Parks Residential Landlord and Tenant Act (ARLTA), a tenant whose landlord fails to provide the tenant with essential services (such as electricity) has a right, after notifying the landlord of the problem in writing and giving the landlord a reasonable opportunity to fix the problem, to sue the landlord for any monetary damages the tenant has suffered as a result of the landlord’s violation of the rental agreement and the ARLTA.
