Question: my apartment complex has all expired fire extinguishers. are they in violation?
Answer: Under the Arizona Residential Landlord and Tenant Act (ARLTA), residential landlords must (among other things) “comply with the requirements of applicable building codes materially affecting health and safety” (A.R.S. 33-1324). If the building code of the local city or town in which a tenant lives requires that buildings contain working fire extinguishing systems and/or equipment but the tenant’s building has none, then the tenant’s landlord is in violation of the ARLTA.
