Question: Ilived in a house for seven years and was wrogfully evicted because the landlord wouldnot fix the septic which was over flowing running under my house which was beyond toxix and smelled bad on the whole block. I ended up calling the EPA on him and he ended up getting fined 7000 dollars. once he found out i did it he evicted me out of retaliation. is this legal or not and whats the statute of limitations on this?
Answer: As a general rule, a residential tenant may only file a motion to set aside an eviction judgment within 60 days or within a reasonable time (depending on the basis of the motion) after the judgment is entered (RPEA Rule 15) and may only appeal an eviction judgment within 5 days after the judgment is entered (RPEA Rule 17).
