Question: Is my landlord required to take action against other residents of my property who are drunken and disorderly and causing a disturbance on the premises? If so, what action are they required to take?

Answer: Under the Arizona Residential Landlord and Tenant Act, a tenant is legally required to “conduct himself and require other persons on the premises with his consent to conduct themselves in a manner that will not disturb his neighbors’ peaceful enjoyment of the premises” (A.R.S. 33-1341). Under the Mobile Home Parks Residential Landlord and Tenant Act, a tenant is legally required to “conduct himself and require other persons on the premises with the tenant’s consent to conduct themselves in a manner that will not disturb the tenant’s neighbors’ peaceful enjoyment of the premises” (A.R.S. 33-1451). A tenant who violates this obligation is in breach of the rental agreement and therefore should receive a written warning from the landlord, and, if the conduct continues even after this formal notice is received, potentially face eviction by the landlord.
