Landlord and Tenant Rights and Responsibilities

questions & answers

Question: I have a roommate that lets her boyfriend come over everyday and stay over every night. We are only paying rent for 2 people, not 3. I have tried talking to her about it and how this is not what I signed on for. Is it legal for her boyfriend to be basically living with us for free?

Answer: If the presence of a third resident were inconsistent with the terms and conditions of a rental agreement, then having a third person live in the dwelling would constitute a violation of the rental agreement. A tenant whose roommate is violating the rental agreement always has the option of alerting the landlord.
