Landlord and Tenant Rights and Responsibilities

questions & answers

Question: I bought a small summer place in an all 55+ rv park. I just found out if your unit is 30 yrs old the owner of the park must inspect your unit before you can put it up for sale. If they don't approve the condition of the unit you can't sell. Is this legal? Why would I not be informed before I bought?

Answer: Under the Arizona Mobile Home Parks Residential Landlord and Tenant Act, a mobile home park landlord may not stop a mobile home owner from selling the mobile home to the buyer of his or her choice, but the mobile home park landlord may “require removal of a mobile home from the mobile home park within sixty days after the sale by a tenant if the mobile home does not meet the current requirements of the rules and regulations and statements of policy, including those pertaining to the size, condition and appearance of the mobile home, and exterior materials with which the mobile home has been constructed” (A.R.S. 33-1452(L)).
