Question: If we have a flood as a tenant do they have to replace carpet?
Answer: The Arizona Residential Landlord and Tenant Act says only that a landlord must “make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition” (A.R.S. 33-1324). If the rental agreement between the landlord and the tenant does not identify who is responsible for particular kinds of repairs, then responsibility in specific situations often depends on whether or not the landlord can claim that the repairs are only necessary because the tenant engaged in some deliberate or negligent act or omission that caused the damage in the first place (A.R.S. 33-1341).
