Landlord and Tenant Rights and Responsibilities

questions & answers

Question: We gave a deposit hold to a real estate agent who said it was to keep our application in first place. In order to rent the house, they were needing 6 months rent ahead of time. She received the hold on the 16th, we submitted an incomplete application on the 17th and on the 21st she requested the remainder. On the 22 I informed her that we would not be able to provide the 6 months of prepaid rent to her as we originally thought and that otherwise we were not eligible to rent the property. She is now saying that we have no right to our hold. On the application it says deposits can be refunded

Answer: You should contact an attorney to discuss your specific rights and responsibilities under your contact with the real estate agent. There are links to free or low-cost legal assistance on this website and the LegalLEARN Helpline toll-free telephone number is 1-866-637-5341.
