Landlord and Tenant Rights and Responsibilities

questions & answers

Question: A mobile home burned down on my land. The mobile home was owned and insured by someone else. I was letting this person keep their mobile home on my land at no coast. (No lease or written agreement). This person received a check from the insurance company and will not pay for the clean up. Is the insurance company by chance responsible for the clean up? Who is responsible for the clean up?

Answer: The answer to this question may depend on (among other things) the nature of your oral agreement with the mobile home owner, the terms and conditions of the mobile home owner’s insurance policy, and whether or not you have independent grounds on which to sue the mobile home owner for monetary damages. If the cost to you of cleaning the site will be significant, then you may want to consider meeting with a private attorney.
