Question: How is my landlord notified I want to take then to court

Answer: If you simply wish to notify your landlord of your intention to sue him/her in court, then you may send your landlord a signed and dated letter describing the basis of your complaint (and, if you wish, providing your landlord with an opportunity to fix the source of that complaint before you start a lawsuit). If you intend to sue your landlord for a failure to comply with his/her obligations either under your rental agreement or under the Arizona Residential Landlord and Tenant Act (A.R.S. Title 33 Chapter 10), then there may be specific procedures that you should follow in terms of providing your landlord with written notice and an opportunity to fix any fixable problems within a reasonable period of time. If and when you actually start a lawsuit, you will notify your landlord by “serving” him/her with a copy of the summons and complaint (which will be described when you fill out the required court paperwork).
