Question: It's been a month with out ac ... I called Thursdayady told me most likely no I e would go check out my ac because according to them 86 degrees was normal inside my house for it being to hot outside. Finally I told her I had a baby' and that him living in that temp wasn't okay The called me back and had someone come look at it until Monday said we have a leak and that he had to submit a work order before he could fix it .he wasn't suppose to come fix it yesterday we received no call and he didn't answer I call maintenance line they said the quote hadn't been looked at yet
Answer: Your problem is governed by the Arizona Landlord/Tenant Act. Under the Act, Arizona Revised Statutes, Section 33-1324 requires the landlord to maintain the premises in a condition that is fit for habitation. 33-1364 requires a landlord to supply a working air conditioner. Your remedies under the Act are not automatic. Calling is not enough. The statute requires you to send a written notice to the landlord describing the problem and demanding action. The notice is deemed delivered if you hand it to the landlord or his representative, or in the alternative, you can mail it by registered or certified mail. Once you have delivered the notice, the landlord has 5 days to fix the problem. If he fails to do so, your remedies are covered under Section 33-1364. You can move into a substitute quarters and be excused from paying the rent for that time period or you can sue the landlord for damages. For more information, you should look at the statutes. Go to the website for the Arizona Legislature: azleg.gov and look under "leg council." There you will find all the state statutes.
