Answer: Under the Arizona Residential Landlord and Tenant Act (A.R.S. Title 33 Chapter 10), a tenant is required (among other things) to “comply with all obligations primarily imposed upon tenants by applicable provisions of building codes materially affecting health and safety” (A.R.S. 33-1341(1)), “keep that part of the premises that he occupies and uses as clean and safe as the condition of the premises permit” (A.R.S. 33-1341(2)), “dispose from his dwelling unit all ashes, rubbish, garbage and other waste in a clean and safe manner” (A.R.S. 33-1341(3)), and “conduct himself and require other persons on the premises with his consent to conduct themselves in a manner that will not disturb his neighbors’ peaceful enjoyment of the premises” (A.R.S. 33-1341(7)). The landlord may wish to deliver to the tenant in question a signed and dated letter citing the Arizona Residential Landlord and Tenant Act (which is automatically incorporated into every rental agreement in Arizona), describing the problem in detail, and demanding that the problem be remedied as soon as possible. Material noncompliance with a rental agreement by a tenant after receipt of written notice from the landlord is potential grounds for the eventual termination of a lease (A.R.S. 33-1368).
