Question: if i have severe medical conditions that are now affecting my ability to pay my rent. am i able to break my lease if i am told by the doc that i need to move with my parents? if so what steps should i take? and if you feel like ur getting unfair treatment due to retaliation over a complaint made with corporate how do you go about handling that situation?
Answer:
Rule: A.R.S. 33-1373 and 33-1375
According to Fair Housing Act, providing reasonable accommodations for an illness come at the discretion of the landlord. Because the individual has entered into a contractual agreement when signing a lease she/he does not fall under the protection of someone who is in the military, law enforcement, or asking to move because of domestic violence.
FHA may cover your particular situation based on the information provided. Terminating a lease without penalty could be considered a reasonable accommodation under FHA if you are able to show that your illness prevents you from a reasonable daily living. The situation you explained does not define a specific disability, length of time with the condition and whether it is temporary or permanent.
