Question: I have a vacation rental that I need to sell. Does the new owner have to honor any future vacation rentals?

Answer: The answer is likely that it depends. If a tenancy is 30 days or longer, it will likely be governed by the Arizona Residential Landlord Tenant Act in which case the tenants may have some rights even after you sold the premises. If the "tenant" has not yet moved in, then they are not yet a leaseholder, and the issue becomes a bit stickier. Still, arguably a tenancy of at least 30 days would grant some rights to the tenant. If it is shorter than 30 days, then the ARLTA would likely not apply to it, and the future tenant may have no rights against the future owner, but may have a breach of contract action against you if you already collected money from them. Either way, if a future owner were to honor the planned rentals, they would also be entitled to the income therefrom.
