Landlord and Tenant Rights and Responsibilities

questions & answers

Question: My lease is for a year, however my landlord notified me that she was selling her house and wants to buy me out of my lease which I still have 3 months left on it. How much should the lease buy out amount be? She is offering me $1000.00, I currently pay $1050.00 monthly for rent and have always been on time.

Answer: A lease agreement is a contract between the landlord and the tenant. Since the landlord is breaking the lease the landlord will be responsible for a material breach of the contract. The lease will control how the situation will be handled, if there is nothing in the lease pertaining to breaking the agreement then you may workout with the landlord how you see fit. There is not set number for a buyout agreement, this is something that could be negotiated. You may want to consider consulting an attorney.
