Landlord and Tenant Rights and Responsibilities
questions & answers
Question: My roomate and I signed a 12 month lease. 3 months into she is leaving and wants me to sign her off the lease leaving me the only one responsible. Do I have to sign her off? I can't afford the place by myself.
Answer: You are not obligated to release her from liability or indemnify her (be responsible) for her obligations to the landlord. If you do that (and the landlord agrees to it), you may bear all of the liability for any unpaid rent (together with costs and attorneys' fees) on your own. Your best best is to approach your landlord and let them know what's going on and see if they will work with you in some manner.
