Question: Can an Apartment landlord legally go through the tenants trash in the dumpster in the building?
Answer: Generally, the police may search an apartment complex dumpster without a warrant. The apartment complex as a "state actor" are probably permitted to search the dumpster under the Fourth Amendment of the Constitution as well. The question is whether or not a tenant has a reasonable expectation of privacy under the law from the landlord relating to discarded items in their trash dumpster.
