Landlord and Tenant Rights and Responsibilities

questions & answers

Question: If I have a neighbor who plays loud music (loud enough that my furniture vibrates and rattles) for hours on end (sometimes well past 11pm) and I notify my landlord what is the landlord required to do about it?

Answer: I cannot find anything in the Landlord/tenant statutes that say a landlord is required to something regarding another tenant. You may want to check with your local city office to see if they have a specific code on noise. For instance, the city of Phoenix has a code: 23-14 Enumeration of loud, disturbing and unnecessary noises; enumeration not exclusive.(b) Radios, phonographs, etc. The playing of any radio, phonograph or any other musical instrument in such a manner or with such volume, particularly between the hours of 11:00 p.m. and 7:00 a.m., as to annoy or disturb the quiet, comfort or repose of persons in any office, hospital or in any dwelling, hotel or other type of residence, or of any persons in the vicinity. If your city has a code such as this, you may want to contact the police department to see what and how to go about making a complaint.
