Question: Is a landlord/apartment manager allowed to put into a lease that any legal action against the complex is subject to additional fees? And, what is the maximum fee allowed for late charges on rent?
Answer: There is no maximun amount for late fees. The only requirement is that they be "reasonable" A.R.S. 33-1368 B. Reasonablness is determined on a case by case basis. For example a late fee of $50 might be considered reasonable if the montly rent was $2000 but not if it were $500, A rental agreement/lease can require that attorneys fees and court costs can be awared to the prevailing party in any legal action. A.R.S. 33-1315 A 2. There is no provision for assessment of any additional costs.
