Question: I signed a lease that will start in a few days.the lease states all appliances will be provided. If upon taking possession of the Unit all appliances are not provided,do I get back my earnest money?

Noncompliance with the terms of a lease is addressed by A.R.S § 33-1361. A.R.S. § 33-1361 states that in the event that the landlord is materially noncompliant with the lease agreement, the tenant may deliver a written notice to the landlord stating the acts that constitute a breach of the lease agreement. If the landlord fails to fix the problem within ten days of the landlord’s receipt of the written notice, the lease will terminate. However, if the landlord fixes the problem within the ten day period, the lease will not terminate.
