Landlord and Tenant Rights and Responsibilities

questions & answers

Question: We gave our 30 day notice our last day was 3/31/13 but because of work and Holidays we couldn't move out till 4/3/13.When going back for our last thing the landlord said they moved it for us but had to take the legs off our table. When me and my husband went to look at the table we seen they had broken it. As well when we were getting our things we had notice an art set had been taken. The art set isn't worth much but they did just take it. Is there anything we can do or do we just have to bite the price of things?

Answer:

A.R.S. section 33-1370

(http://www.azleg.gov/ArizonaRevisedStatutes.asp?Title=33) states that if a tenant has left behind personal property, the landlord shall hold the property for the tenant for a period of time. The landlord must notify the tenant of the holding of the property. There is no apparent statute for whether a landlord is responsible for broken personal property in the moving process.
