Question: I live in an apartment building and I do not have a lease at this time my lease was up and I just never renewed it the building is now owned with a new landlord and I am no longer comftroble living her my rent is do no latter then the 3 rd of feb if I want to move out befor the rent is due do I need to give a 30 day notice or pay rent for February?

Answer: Arizona Revised Statute 33-342  states: “When a lessee holds over and retains possession after expiration of the term of the lease without express contract with the owner, the holding over shall not operate to renew the lease for the term of the former lease, but thereafter the tenancy is from month to month”. The landlord or the tenant may terminate a month-to-month tenancy by a written notice given to the other at least thirty days prior to the periodic rental date specified in the notice. A.R.S. § 33-1375
