Landlord and Tenant Rights and Responsibilities

questions & answers

Question: Can the lease be broken if its infested with cockroaches and my health is at stake? I have a dr.'s note showing that i i am allergic to their feces.

Answer:

The following is provided for general information only. The Rights and Responsibilities of a Landlord and Tenant are largely governed by the Arizona Residential Landlord and Tenant Act. ARS 33-1324 requires the landlord to maintain the premises in a “fit and habitable condition.” Specifically, a landlord must maintain in good and safe working order and condition all electrical, plumbing, sanitary, heating, ventilating, air-conditioning and other facilities and appliances, including elevators, supplied by him. The landlord generally has a "reasonable timeframe" to make the necessary repairs to ensure the premises are in a “fit and habitable condition.” You may wish to carefully review your lease to determine which circumstances or provisions allow you to terminate the lease early. You may also wish to contact the Maricopa County Attorney's Office Roach Infestation line for further information at (602) 506-6616.  To find out how the law applies to a specific situation, contact an attorney directly.
