Question: I lost my job and am unable to pay my lease. What happens if I break a lease, yet there isn't a provision in lease regarding breaking the lease.

Answer:

It may be helpful to carefully review the terms of the lease regarding provisions for early termination. Discussing the situation with the landlord may also beneficial. ARS 33-361 describes the course of action a landlord may pursue in the event that a tenant violates the lease. The landlord may reenter and take possession of the property, or without formal demand or reentry, commence an action to recover possession of the premises. Also, the landlord shall have a lien upon and may seize as much personal property of the tenant located on the premises and not exempted by law as is necessary to secure payment of the rent.
