Question: If a person is renting in an apartment complex and the landlord does not maintain the pool what are the rights of the tenants. The pool is green and pool care company reports landlord does not want to pay for all the right chemicals. This has been on going for 2 months at least.

Answer: - Speaking about the Department of Health, ARS 36-132  says they shall supervise, inspect and enforce the rules concerning the operation of…public and semipublic swimming pools adopted pursuant to section 36-136, subsection H, paragraph 10. ARS 36-136(h)(10) says the director, by rule, shall prescribe reasonably necessary measures to prevent pollution of water used in public or semipublic swimming pools …and to prevent deleterious health conditions at these places. The rules shall prescribe minimum standards for sanitary conditions that shall be maintained at any public or semipublic swimming pool…and shall provide for inspection of these premises and for abetment as public nuisances of any premises and facilities that do not comply with the minimum standards, see ARS 36-136(h)(10).  By calling the Division of Public Health Services at (602) 542-1023, they may be able to direct a caller to the correct department for violations.
