Question: hi my landlords are refusing to do anew lease they are thing of selling the realtor gave us a 60 day notice but i haven,t found anything yet i still have to pay them rent and they wont fix the home where i live at

Answer: Once a rental agreement expires, the landlord is under no obligation to renew it. If the landlord and the tenant agree, the rental agreement can become month-to-month, with both parties having the right to terminate it with 30 days advance notice (A.R.S. 33-1375). As far as rent and repairs are concerned, Arizona law requires that landlords “make all repairs and do whatever is necessary to put and keep the premises in a fit and habitable condition” (A.R.S. 33-1324) but it does not permit tenants to withhold all or any portion of their rent in order to compel their landlord to make required repairs (A.R.S. 33-1368(B)). A tenant who wants the landlord to make repairs may wish to ask the landlord in a formal signed and dated letter.
