Question: I wish to evict my 18 year old son. There has never been a lease as he has been a minor until recently. There are reasonable household rules regarding drinking, drugs, smoking, language, chores, etc. He chooses to disobey rules because he claims he can as an adult. He neither works nor pay rent nor contributes financially. How do we evict him?

Answer: If a person is a considered a tenant, then the landlord must provide them with advance written notice of the landlord’s intention to terminate the rental agreement. (A rental agreement may be written or verbal (A.R.S. § 33-1310)). The usual notice period is 30 days before the beginning of the next rental period (A.R.S. § 33-1375). However, if a person is merely an unwanted guest, rather than a tenant with a rental agreement, then the owner, landlord, or other lawful occupant of the dwelling may simply kick them out, and, if necessary, ask the local law enforcement agency to remove them (A.R.S. § 33-1378).
