Question: if we served someone with a 3 day notices about 2 months ago is that still good to open a case or would we have to serve another one?
Answer: If a landlord provides a 30-day notice to a tenant who is renting a dwelling on a month-to-month basis pursuant to A.R.S. 33-1375(B) but the tenant continues to occupy the dwelling with the permission of the landlord – and especially if the tenant continues to pay *any* rent, then the landlord may wish to provide another 30-day notice to tenant so the tenant cannot claim in court that they thought that the previous notice was withdrawn or no longer applied.
