Question: My landlord is evicting me for non-pymt. I did remind them the govt is shut down and could they just apply my deposit to the rent. They know i am on dialysis and my only income come from my x-husband. They made me sign a 5 day notice to pay or quit. Do i have to leave in 5 days?
Answer: Once a tenant has received a 5-day notice for nonpayment of rent, then must either pay all the overdue rent and late fees that they owe or leave within the 5-day period, because if they remain beyond 5 days they will be subject to eviction (and will owe not only all the overdue rent and late fees but also court costs as well as any reasonable attorneys fees incurred by the landlord, and an eviction judgment will be placed on their record) (A.R.S. 33-1368(B)).
