Answer: A landlord may file an eviction complaint with the court even if there is no written lease, because an oral rental agreement is enforceable too. The landlord may do this only after providing the tenant(s) with written notice as required by law. Anyone who is a tenant under an oral rental agreement may be evicted. However, a tenant should not have an eviction placed on their record unless they have received a summons and a copy of the complaint in advance naming them as a defendant at a scheduled eviction hearing so that they have an opportunity to appear at the hearing to defend themselves.
