Question: My landlord gave me a noise complaint and unauthorized tenant notice on April 11, 2018 . I asked landlord, who is the unauthorized occupant. She said your son. I assured her that , my son do not live here, buy he is my babysitter while I'm at work. Then on May 4, I went into pay rent , The landlord received my rent. I asked her how is the noise, she stated it have not gotten any better and you totally disregard the 10 day for having an unauthorized occupant. I told her I told you my son do not live here. The landlord said he is always here and I told her , yes, because I'm always at work.

Answer: Whenever a tenant gets a written notice from their landlord alleging that the tenant has violated the rental agreement, and the tenant disagrees with that allegation, it is always recommended that the tenant respond to the notice in a signed and dating writing to the landlord – before the 10 days are up – describing how the tenant is and intends to remain in compliance with the rental agreement. That way, it will be more difficult for the landlord to claim that the 10-day notice was ignored and the tenant continued to violated the rental agreement.
