Eviction

questions & answers

Question: Ive been living with a woman for 15 yrs (shes still married from previous marriage) and I've asked her to leave and she will not. what are my rights - I am owner of the home we are living in and shes not working. Its a volatile relationship and concerned about it. what can I legally do to evict this person

Answer: Provide the tenant a written notice indicating that her tenancy is being terminated in 30 days. If she does not leave by that time you can file a forcible entry and detainer (eviction) action in Justice of the Peace Court seeking a court order to have her removed. The necessary forms can be found of the website at your local self-service center at your county Justice Court or you can go to the Maricopa County Justice of the Peace Court.
