Question: My father passed away on 9/2/15 and I have been made the personal representative of his estate, he had a roommate living with him for 3 years that never paid rent. How do I go about notifying him he needs to move out once the house is sold?
Answer:
The Probate Court in the County where your father died must formally appoint you “Personal Representative” (A.R.S. Title 14, Chapter 3, Article 6). Thereafter, you have power to control your father's real property, including filing Eviction Actions. You can get the Eviction forms from the local Justice Court for the county where the property is located.
