Question: My mother recently passed away & she had a live in boyfriend. Everything was left to us like her house & I was wondering how we go about having her boyfriend move out? What should we do? We have all the legal documents stating her house is now our house but have no idea what to do about getting him out. How does eviction work when he's got no rights to the house or anything else?

Answer: Assuming valid proof of legal ownership (name on deed), a property owner has “standing” to evict an occupant who has no lawful right to possession. However, first, the owner must verify that the occupant (live-in boyfriend) did not establish some form of "tenancy", for example, an enforceable agreement with your mother. You should consider seeking advice from an attorney who can identify the facts (and then the law) before taking formal action.
